No one likes to think about death, but it’s an inevitable part of life. Planning ahead with estate planning is the best way to ensure your affairs are in order and to reduce stress on your loved ones. Even if you don’t have substantial assets, a basic estate plan—such as a will—can make a significant difference.

What is a Will?

A will is a legal document that outlines your final wishes. It primarily details who will inherit your money, property, and other assets when you pass away. A will can also:

  • Name guardians for minor children

  • Specify instructions for your funeral or memorial

  • Direct assets to heirs, friends, or charities

While a will may be sufficient for individuals with limited assets, it must go through probate. Probate is a legal process where a court validates the will, which can take time. Family members may also attempt to contest the will, adding stress during an already emotional period.

Although online templates exist, it’s best to discuss your unique situation with an experienced estate planning attorney to ensure your wishes are properly documented.

Types of Wills

There are several types of wills, including:

Testamentary Will

  • Also known as a last will and testament, this is the most common type of will.

Pour-Over Will

  • Works alongside a trust and covers assets not transferred into the trust before death.

Holographic Will

  • Handwritten and signed by the creator. Florida does not recognize holographic wills.

Oral Will

  • Spoken rather than written, usually on a deathbed. Florida also does not recognize oral wills.
